Terms of Service

    Terms and conditions governing your use of the ShiftSphere platform.

    1. Acceptance of Terms

    By accessing or using ShiftSphere ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

    2. Service Description

    ShiftSphere is a cloud-based workforce management platform providing attendance tracking, payroll processing, leave management, and related HR tools. The Service is provided on a subscription basis as described in your plan.

    3. Account Responsibilities

    You are responsible for: maintaining the confidentiality of your account credentials, all activities under your account, ensuring your use complies with applicable employment and data protection laws, and the accuracy of data entered into the platform.

    4. Acceptable Use

    You agree not to: reverse engineer the platform, use it to process data for organizations you don't represent, attempt to access other tenants' data, use automated tools to scrape or overload the service, or use the platform for any unlawful purpose.

    5. Data Ownership

    You retain ownership of all data you input into ShiftSphere. We claim no intellectual property rights over your employee records, payroll data, or organizational information. We use your data solely to provide the Service as described.

    6. Payment Terms

    Paid plans are billed monthly or annually as selected. Prices are exclusive of applicable taxes. We may change pricing with 30 days notice. Non-payment after 7 days may result in service suspension. Refunds are available within 14 days of initial purchase for annual plans.

    7. Service Availability

    We target 99.9% uptime (see our SLA). Scheduled maintenance windows are communicated 48 hours in advance. We are not liable for downtime caused by force majeure, third-party service failures, or your network connectivity.

    8. Limitation of Liability

    ShiftSphere's total liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption.

    9. Termination

    Either party may terminate with 30 days written notice. Upon termination, you have 14 days to export your data. We will delete your tenant data within 30 days of the export period ending. Sections on liability, IP, and dispute resolution survive termination.

    10. Governing Law

    These terms are governed by the laws of India. Disputes shall be resolved through arbitration in Chandigarh, Punjab under the Arbitration and Conciliation Act, 1996.
